TERMS & CONDITIONS OF SALE

Qualified Customers Only

     The ElectricalDeals.com website is directed towards knowledgeable buyers. By placing orders through this website, the buyer represents that he or she is knowledgeable in the selection, application and installation of electrical products. If you are uncertain of your ability to correctly select or install electrical products, you should consult with a qualified electrical contractor or technician before ordering or installing.

     Our website offers money saving deals to our customers.  This is done in part by keeping costs down.  We keep costs down by conducting transactions with knowledgeable customers who do not require assistance in product selection and do not require return material services.  Also, certain items may only be purchased in multiple quantities. Payment must be made by credit card or, alternatively, you may mail a paper check after entering your order via this website.

Returned Goods Policy

     Material may not be returned without our prior authorization.  We will give full credit for merchandise returned due to defects, subject to the terms of the manufacturer's warranty.  We will also give full credit for errors by us provided your request is made within seven days of your receipt of the merchandise.

Returns due to customer error or change in requirements may be subject to a 20% or greater restocking charge, any outbound freight not originally billed to the customer and return freight charges. We also reserve the right to refuse return authorization.  The minimum restocking charge shall be $15. Returns must be requested within 30 days of our shipment date.

Return authorization may be requested by clicking on this return authorization link or the the link that appears at the bottom of each page.  We reserve the right to refuse unauthorized returns.

Prices

     Any prices that may be found on this website or other material distributed by us are for immediate purchase only and are subject to change or correction without notice.  Therefore, they are not offered by us as quotations for future purchase. Prices do not include sales taxes or shipping charges.

Order Acceptance

     All orders are subject to our acceptance as well as availability of product.  The automated email response we send for each order received does not constitute acceptance.  While it is our intent to deliver your order promptly, we cannot be liable for damages due to delivery delays of any kind.  Orders are accepted FOB point of shipment.

Freight Charges / Small Order Charge

     Within the 48 contiguous United States: When we advertise/offer “Free Freight” on this website, there shall be no charge for freight or handling unless the customer directs us to ship via expedited (premium) transportation. When we advertise a flat charge to ship, then we will bill only for that amount.  In the absence of any specific offer, the customer shall be responsible for shipping and handling charges. The amount of any shipping and handling charges will be stated prior to requesting your payment information.

     Shipments to Alaska and Hawaii shall be subject to additional freight charges beyond those calculated at check-out.  You will be advised of these additional charges and given a chance to cancel your order before we proceed with the order.

     Also, at times, we may impose a small order charge. If we do, you will be advised prior to submitting your payment information.

Freight Claims

     All shipments are made FOB shipping point.  In the event of loss or damage to a shipment, you must note any shortages or damages on the delivery receipt, and then request the delivering carrier to make an inspection.  A claim must then be filed on the carrier without delay.  Claims for concealed loss or damage must also be filed with the carrier immediately upon discovery.  While we do not assume any responsibility for freight claims, we will provide reasonable assistance to help you bring about settlement with the transportation company.

Payment Terms

     All sales are subject to payment at time of order placement.  We accept Visa, Mastercard, Discover and American Express.  You may also mail a paper check after entering your order. See Payment Information for more detail.

Warranties

     All of the products we sell are brand new and obtained directly from the manufacturer.  We do not sell reconditioned product. We warrant that all goods sold are free of any security interest or other lien and will in addition make available to you all transferable warranties made to us by the manufacturers of the goods.  ElectricalDeals.Com makes no other express or implied warranties and specifically makes no implied warranties of merchantability or fitness for purpose.

Limitation of Liability

     ElectricalDeals.Com's liability shall be limited to either the replacement of the goods or refund of the purchase price and in no case shall it be liable for incidental or consequential damages.

No Responsibility for Information Provided

     Product information contained on this website is derived from publications of the product manufacturers.  This information is necessarily based upon approved code installation and use under proper working conditions.  We assume no responsibility by reproducing such information, and in no way do we give a guarantee, expressed or implied, on any product.

Governing Law

     Any transactions arising out of the buyer’s use of this website or otherwise initiated with Electricaldeals.com, shall be governed by and construed in accordance with the internal laws of the State of Michigan applicable to agreements made and to be performed entirely within that State, without regard to the conflicts of laws principles of Michigan.

Arbitration

     Any dispute regarding interpretation or enforcement of any of the parties' rights or obligations under any transactions between the buyer and Electricaldeals.com shall be resolved by binding arbitration according to the rules of the American Arbitration Association in the County of Wayne, State of Michigan.  The parties irrevocably submit to personal jurisdiction of any State court in the County of Wayne or the United States District Court for the Eastern District of Michigan, in any action or other legal proceeding to enforce any award made by the arbitrators.  The arbitrators may award attorneys fees to the prevailing party in any arbitration proceeding.  All costs and expenses of the arbitration, including actual attorney's fees, shall be allocated among the parties according to the arbitrator's discretion.  The arbitrator's award may be confirmed and entered as a final judgment in the courts noted above and enforced in accordance with the arbitration statutes of the State of Michigan.  Proceeding to arbitration and obtaining an award thereunder shall be a condition precedent to the bringing or maintaining of any action in any court with respect to any dispute arising under such transactions.

SHIPPING INFORMATION

     Our goal is to ship orders for in-stock items the same day or next business day depending upon time of receipt, work load and processing requirements. We attempt to obtain and ship out of stock items as readily as possible.  Some items may be shipped direct to you from our supplier.

     We do not ship to destinations outside the 50 United States.  Sorry, we also do not ship to PO Boxes, APOs or FPOs.

     We most often ship your order via UPS.  However, at our option, we may also ship via a common carrier such as Roadway or TNT. We may also ship via U.S. mail.

SALES TAX INFORMATION

     We do not charge sales tax on shipments made to any state other than Michigan.  We will charge sales tax on shipments made within the state of Michigan, with limited exceptions as follows: Industrial, educational, religious, non-profit & governmental users located in Michigan may request a tax exemption certificate by e-mailing us at info@electricaldeals.com. If, in our sole discretion, the customer qualifies for sales tax exemption, we will waive the sales tax.  In no event will we waive the sales tax for contractors with shipping addresses in the state of Michigan.

PAYMENT INFORMATION

Credit Cards

     We accept payment by any of the above charge cards as well as paper check via mail.  Bank cards (Visa & MasterCard) must be issued by U.S. banks.  We must be able to obtain approval from your charge card company at the time of order entry.  Generally, but not always, we will bill your account on the date of shipment.  However, we reserve the right to bill your account prior to shipment in the event we special order product for you or direct ship product to you.

     For your protection and quicker approval of credit card orders, you must provide us with the billing address that is on file at your credit card company.  Your shipping address must also be on file with your credit card company.  If your shipping address is not on file with your credit card company, please contact them to submit your valid shipping address(es).   Their phone number is on the back of your credit card.

Paper Check VIa Mail

     We will accept your order over the Internet and wait for your mailed check to arrive. When “checking out” your purchase, click on the “Mail Your Check” option.  We will ship after your check has had time to clear the banking system.

     We do not use your IP address for any purpose.  However, our site does use cookies to keep track of your shopping cart.

     Our site uses an order form for customers to request information, products, and services.  The only visitor information we collect is:  Contact name, company name, email address, shipping address, phone, fax and credit card number.  Contact information from the order form is used to fulfill customer requests and orders.   Contact information is also used to get in touch with the customer when necessary.   Contact information may also be used for future promotional mailings.   However, users may opt-out of receiving future mailings (see the next paragraph).  Financial information that is collected is used only to bill the user for products and services.
